Distance Sales Agreement

This Distance Sales Agreement (the “Agreement”) is concluded electronically under Turkish Consumer Protection Law no. 6502 and the Regulation on Distance Contracts (dated 27.11.2014) between the Seller identified below and the Buyer placing an order via byalihome.com. By confirming the order, the Buyer acknowledges having read and accepted all terms of this Agreement.

2. Buyer
The name, delivery and billing address, phone and e-mail entered by the Buyer at checkout are taken as basis. The Buyer is responsible for the accuracy of this information.
3. Subject of the Agreement
This Agreement sets out the rights and obligations of the parties regarding the sale and delivery of the product(s) whose qualities and price are stated in the order summary and on the invoice, ordered electronically by the Buyer from the ByAli Home website.
4. Product, Price and Payment
- The type, quantity, brand/model, price and the total amount including all applicable taxes are shown on the order page and in the order confirmation e-mail.
- Prices are those valid at the time of the order and remain in effect until updated.
- Payment can be made by credit/debit card (via the iyzico infrastructure) or by bank transfer/EFT. Card details are never stored by ByAli Home; payments are processed by a licensed payment institution.
- For bank transfer/EFT, the order number stated in the payment description must be referenced.
5. Delivery
- Products are shipped to the Buyer’s stated delivery address via our contracted courier.
- Delivery takes place within the period stated on the order page and never exceeds the statutory maximum of 30 days from payment confirmation. For handmade/personalised items, the preparation time is communicated separately.
- If the package is visibly damaged on delivery, the Buyer should refuse it and have the courier draw up a report.
6. Right of Withdrawal
The Buyer may withdraw from the Agreement within 14 (fourteen) days from delivery, without giving any reason and without penalty. Notice of withdrawal may be sent to info@byalihome.com or by phone (0531 425 67 53); it is sufficient that the notice is dispatched within the period.
Returned items must be sent unused, resalable and with their invoice and all accessories. The price is refunded via the Buyer’s original payment method within 14 days of receiving the withdrawal notice.
7. Exceptions to the Right of Withdrawal
Under Art. 15 of the Regulation on Distance Contracts, the right of withdrawal does not apply to:
- Products prepared to the Buyer’s specifications or personal needs (e.g. name/date-printed, custom-sized or bespoke artwork).
- Products that are perishable or unsuitable for return by their nature.
- Products unsuitable for return for health/hygiene reasons once unsealed.
8. General Provisions and Dispute Resolution
- Where a product is defective, the Buyer holds the statutory rights under Law no. 6502.
- For disputes, the Consumer Arbitration Committees and Consumer Courts at the Buyer’s place of residence or the place of transaction have jurisdiction, within the monetary limits announced by the Ministry of Trade.
- This Agreement enters into force upon the Buyer’s confirmation of the order and is stored electronically.
